Refund Policy

1. General Refund Policy
Dealer Data One, Inc. (“Dealer Data One,” “DD1,” “we,” “us,” or “our”) operates on a subscription-based software-as-a-service (SaaS) model.
All fees paid to Dealer Data One are non-refundable, except as expressly stated in this Refund Policy or as required by applicable law.
By purchasing or subscribing to the Services, you acknowledge and agree to this policy.
Cancellation
Cancelling your subscription and requesting a refund are different things. You may cancel at any time under Section 7.3 of our Terms of Service; cancellation stops future charges and takes effect at the end of your current billing period. This Refund Policy governs whether fees already paid are returned.
2. No Refunds for Standard Use
We do not provide refunds for:
- Partial subscription periods
- Unused services or features
- Failure to use the Services
- Customer dissatisfaction not related to service availability
- Changes in business needs or circumstances
- Termination due to violation of our Terms of Service
This applies to all monthly and annual subscription plans.
3. Limited Exception – Major Service Disruption
Refunds or service credits may be considered only in the event of a Major Service Disruption, defined as:
- A complete outage of the core Services
- Caused by Dealer Data One
- Lasting seventy-two (72) consecutive hours or more
- That materially prevents access to or use of the Services
Planned maintenance, third-party platform outages, force majeure events, or issues caused by user configuration do not qualify as Major Service Disruptions.
4. Remedy for Eligible Disruptions
If a Major Service Disruption occurs and is confirmed by Dealer Data One:
- The primary remedy will be a service credit applied to a future billing cycle
- Refunds, if issued, will be prorated and limited to the affected service period only
- Dealer Data One reserves the sole discretion to determine whether a refund or service credit is appropriate
Under no circumstances will refunds exceed the fees paid for the affected billing period.
5. Request Process
To request consideration under this policy, you must:
- Submit a written request to legal@dealerdata.one within thirty (30) days of the alleged disruption
- Include account details, dates of impact, and a description of the issue
Failure to submit a request within this timeframe constitutes a waiver of any refund claim.
6. Payment Disputes and Chargebacks
We ask that you contact us before initiating a chargeback or payment dispute. Most billing concerns are resolved faster directly.
Where a dispute is initiated, we may suspend access to the Services while the dispute is pending, and will provide transaction records to the card issuer as requested. Access is restored on resolution.
Nothing in this policy limits any rights you have under your card issuer's or payment provider's dispute procedures, or under applicable law.
7. Changes to This Policy
Dealer Data One reserves the right to modify this Refund Policy at any time. Changes will be effective upon posting to our website.
